What 10th Amendment?

The reshaping, all the constitutional renovations Obama is doing right this moment in American history is largely irreversible. I knew these changes would be so the night I sent emails to this blog's contributors asking their participation in 'chronicling the fall of liberty.'

Obama's ability to do the things he's now doing has been planned, worked toward, and ultimately staged over decades of indifference and slow indoctrination, just waiting for the day the right president would gain the oval office. I don't suggest this was a concerted effort to bring about the end of constitutional America, but I do suggest that march to socialism-- steadily AWAY from our constitutional founding --has been a slow creep of decades, one progressive victory at a time, however small.

What we are witnessing is not so much the death of a nation-- the US will go on in name, if not character --but rather the end of the America our founders envisioned. No, they did not envision, phones, televisions, or any other example of 21st century technology. Had they, they might have felt like Mr. Anderson struggling with the impossibility that his mouth has suddenly ceased to exist...

And that's where we are today-- our mouths might as well not exist, for no one of consequence in government is listening. And if anyone is listening they too have discovered their own voice accounts for nothing in the grand scheme of things. Your vote on any national election day is pointless; the game has been rigged. Congress has its own agenda and nothing you or I do in the voting booth will matter. To be sure, their progress has slowed on occasion, but the march has never once ceased.

The enemy is going to take everything you once held dear. Get used to the idea, because there's nothing you can do to stop it.


Rediscovering the 10th Amendment -- too little, too late

The New Deal, launched almost 80 years ago, represented a giant leap toward collectivism. But only in the last few weeks, as a result of President Barack Obama's New Deal Reloaded, have some 20 states rediscovered the Constitution and the 10th Amendment.

In describing the constant blatant assault on the Constitution, one hardly knows where to start. The federal government runs Social Security, a 50-state Ponzi scheme that makes Bernie Madoff look like an underachiever. What about Medicaid? It is a federal/state program of healthcare for the poor. What about the Department of Education? It unconstitutionally involves the federal government in state-run education and comes with rules and mandates attached to the money.

Today large numbers of Americans, to the extent that they even know about Article I, Section 8, couldn't care less about it.

FDR personified this view at the swearing-in ceremony for his second term. He later said that when it came to the words "support the Constitution of the United States," he thought, "Yes, but it's the Constitution as I understand it, flexible enough to meet any new problem of democracy -- not the kind of Constitution your court has raised up as a barrier to progress and democracy."


We may be able to slow the progress. But honestly, how do you change the mind and heart of a nation 300 million-plus strong to return to constitutional government? How do get recipients of welfare to give up the dole? How do you get the unions out of education? How do you put God back into the hearts of minds of people who have been taught that government is god? How do you change the heart of a nation that views abortion as a viable instrument of 'family planning'?

The heart of America is corrupt, because government is corrupt.

And judgment lies at the door.

    All the things listed in Mr. Elder's piece are long settled, broadly-popular programs. Unless you can point to new programs from the Obama administration (not George Bush or Congress) then this is baseless fear-mongering.

    Let me go even further that for a party to seriously discuss secession can be seen an act of treason and sedition. That was the heart of the Civil War, whether the southern states could secede over policies they didn't like.

    For a party whose brand is uber-patriotism, this new infatuation with the tenth amendment is well sickening.

  4. For one, Barack has all but confiscated the auto industry. GM for example has been told by the Obama administration what cars they are expected to make and what not. He's taking over businesses left and right, firing CEO's, telling companies how much they can pay their executives, telling them when they can and cannot file for bankruptcy.

    Two, his administration is directly responsible for attacking free speech; deliberately targeting private citizens who express the unpopular opinion that they hope the changes he desires to foist upon America fails.

    Three, he had made provocative moves that, if enacted, would undermine the second amendment.

    Four, attempts to win for the people of America "free" available to all, universal health care is, likewise, unconstitutional.

    His idea to give everyone a climate control meter on their home's heating and cooling systems. It's down-right Orwellian.

    But none of this was the point of the post.

Because, constitutionally, government funded public education is unconstitutional... the Dept of Education is unconstitutional.

    I know all the things Elder mentioned (and more) are "largely popular. But they are, by and large, unconstitutional.

    The tenth amendment merely states that: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."I don't argue that Obama is taking us into uncharted waters [though he really is], because this nation's present course was laid for him over the last 80-90 years.

    The department of educations is unconstitutional. The Federal Reserve is unconstitutional...

    There is no governmental control according to the Supreme Court of the United States. No governmental control = UNCONSTITUTIONAL.

    [Lewis v. United States, 680 F.2d 1239 (1982)]

    The court ruled that the Federal Reserve Banks are "independent, privately owned and locally controlled corporations", and there is not sufficient "federal government control over 'detailed physical performance' and 'day to day operation'" of the Federal Reserve Bank for it to be considered a federal agency...

    Congressional Attempts to Control the Fed:

    --1937 Rep. Charles G. Binderup of Nebraska:

    "In fact there has never been an independent audit of either the twelve banks of the Federal Reserve Board that has been filed with the Congress ... For 40 years the system, while freely using the money of the government, has not made a proper accounting."--1952 Rep. Wright Patman of Texas (House Banking Chairman)

    "...one of the most secret societies. These twelve men decide what happens in the economy ... In making decisions they check with no one-- not the President, not the Congress, not the people."Patman also said:

    "In the United States we have, in effect, two governments... We have the duly constituted Government... Then we have an independent, uncontrolled and uncoordinated government in the Federal Reserve System, operating the money powers which are reserved to Congress by the Constitution."--1971 Rep. John R. Rarick of Louisiana introduced H.R. 351:

    "To vest in the Government of the United States the full, absolute, complete, and unconditional ownership of the twelve Federal Reserve Banks."

    He said: "The Federal Reserve is not an agency of government. It is a private banking monopoly."--1980's. Rep. Phil Crane of Illinois called for the repeal of the Federal Reserve Act. In 1980 congress passed the Monetary Control Act. It gave the Federal Reserve control of all banking institutions.

    None of this happened on Obama's watch. I never said it did. But Obama and Rohm Emmanuel (not content to let a good crisis go to waste) are using the confusion in these hard economic times to push an agenda that is ultimately socialist. He is on the verge of fascism:

    "a governmental system led by a dictator having complete power, forcibly suppressing opposition and criticism, regimenting all industry, commerce, etc., and emphasizing an aggressive nationalism and often racism.""Don't be a sheep?"Don't be an ass... Please. You're becoming a bore.

    "Uber-patriotism"? Not really; it only seems that way to the Left because they have no real love of country to begin with... no sense of American Exceptionalism... no real pride of country. If that weren't the case, liberals like Obama... the president of the United States himself... wouldn't spend all his time overseas apologizing for how horrid the United States is. This from a man who couldn't find it in his own personal civic pride to place his hand over his heart during the National Anthem. The very same man who steadfastly refused to wear a flag lapel pin until he won the nomination and had to begin courting ALL of America.

    Yes, President Obama IS a historic figure. but that's not necessarily a good thing. He will, in all likelihood, be a one term president.

    Question is, after all the damage he's done to the economy in 90 days, think of what the damage will be by the end of four years.

    Like I said in the post, "there's nothing you can do to stop it."I'm hoping I'm wrong. I'm hoping the game ISN'T rigged. Because I want to believe that when I fill out my next presidential ballot, my vote will actually choose a man worthy to be president.

    Barack is certainly president, but his is certainly NOT worthy of the title.

    Not a one of you on the left accord George Bush the same courtesy after the 2000 election. And you've all sought to destroy him politically. What great patriotic Americans you all are!

    What about his oath of office? To protect and defend the constitution from ALL enemies foreign AND DOMESTIC? This departure from the constitution began under Teddy Roosevelt and Woodrow Wilson, codified in stone under FDR... No president since has kept his oath of office.

    And that goes for Barack Obama as well. Because each and every president thereafter allowed the unconstitutional policies enacted by his predecessors to stand. They didn't try to reverse the trend, they piled on and compounded the damage to our constitution, until now, where we have arrived at what appears to be the end of American Constitutionalism.

    But you're fine with that, aren't you. All the unconstitutional programs are "settled, broadly-popular programs." You don't care whether or not the nation has veered off course because you LIKE the fact that the America our founding fathers established is crumbling before our very eyes.

You are the sheep, brainwashed by unconstitutional government education; sold into intellectual slavery by the lie that THIS is what America is supposed to look like. It is your ignorance, and that of the untold millions of other such sheep, with no real understanding of what America was designed to be, that has all but destroyed America. You are responsible. Because you've allowed a corrupt government to tell you what to believe. How to believe. Why to believe. You do NOT think for yourself. You resort to quoting men like John Stewart....?

    Well, he had eight years of a Bush presidency to draw from... we've had just under 100 days of Obama. What will we have when he's tossed out in four years?

    You only believe what other liberals tell you. How can I say this? Because all the posts here wherein you've commented have ALL been in disagreement. Those times when our opinions appeared to converge was when I shifted MY opinion to match yours. You do NOT shift your opinion at all. You believe only what you're told by those who've brain-washed you.

    You need to take your mind out of your handlers back pockets and learn to think for yourself. Until you do that, there is no point whatsoever in debating you. Because you can't think for yourself. You can only bleat out the same idiocy that comes out of every other liberal-diseased American mind.

    So Barack Obama isn't actually a socialist/fascist. He's just the president who happens to be in charge when we finally come to the tipping point for you constitution originalists.

    If the point you want to argue is that our country over the past 80 years has moved away from the constitution then don't start your arguments with Barack Obama.

    The programs that you see as destroying our nation are the ones I see as strengthening. What would happen to elderly without social security? How could technology advance if we didn't have a public education system? Without federal taxes there would be nothing like the interstate system or Hoover Dam spurring growth? What is your alternative vision of where our nation should be if we could roll back all these programs?

    Do you see states taking on these roles? 50 state education departments, 50 separate elderly insurance programs? What would be the practical difference except more money lost to bureaucracy and duplication?

    Our constitution is not a religious document. The founding fathers were not divine beings. We don't have to have faith or follow their ideas blindly. The ideas the proposed: a government of three branches, a ban on state-sponsored religion, free speech, representation of the populace continue to guide us to this day.

    You have a problem with individual programs not the broad scope of our government.

    Emotional arguments have very little weight with me. I'm sorry if that seems to be your forte and you meet with little success. Also there's the problem that I like to know what I'm speaking about before I comment. So very seldom will my opinions be uninformed that makes me more firm in my opinions. Your First Amendment right to free speech is a privilege and comes with a measure of responsibility. You have the right to exercise that responsibility here but we reserve the right to inform you when you've used that right irresponsibly.

We are benevolent dictators in this regard. Enjoy.
